By accessing and using CheckMyADA (“the Service”), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
CheckMyADA is an automated website accessibility scanning tool that uses browser-based testing (Playwright + axe-core) and AI to identify potential WCAG 2.1 AA violations on web pages. The Service provides scan results, AI-powered explanations, and general guidance for remediation.
3. Important Disclaimers
Not Legal Advice
The Service does not provide legal advice. Our scan results, reports, and recommendations are for informational purposes only and should not be construed as legal counsel. For legal advice regarding ADA compliance, consult a qualified attorney.
No Guarantee of Compliance
We do not guarantee that using our Service will make your website fully ADA compliant or protect you from legal action. Automated scanning can detect approximately 58% of WCAG 2.1 AA criteria. The remaining ~42% requires manual expert review. A clean scan result does not mean your website is fully accessible or legally compliant.
AI-Generated Content
Our AI-powered explanations and fix suggestions are generated by machine learning models and may contain inaccuracies. Always verify AI suggestions before implementing changes to your website.
4. Acceptable Use
You agree not to:
- Scan websites you do not own or have authorization to test
- Attempt to bypass rate limits or abuse the scanning infrastructure
- Use the Service to perform security testing, penetration testing, or vulnerability scanning
- Submit URLs designed to exploit, attack, or compromise our systems (including SSRF, injection, or similar attacks)
- Resell, redistribute, or white-label scan results without authorization
5. Free Tier Limitations
The free tier is limited to 3 scans per day, scanning 1 page per scan. We reserve the right to modify these limits at any time. Free tier scan results may be retained for a limited period and are not guaranteed to be available long-term.
6. Intellectual Property
The Service, including its design, code, scanning engine, and AI models, is our intellectual property. Scan results generated for your websites belong to you and you may use them as you see fit.
7. Limitation of Liability
To the maximum extent permitted by law, CheckMyADA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless CheckMyADA and its operators from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
9. Modifications
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
